Marathon Travels makes no representations or warranties of any kind,
express or implied, as to its completeness or accuracy. Marathon
Travels shall not be held liable for any direct, indirect or consequential
loss or damage howsoever arising from the use of the information
contained in the website. These terms do not exclude or limit the
application of any provision of any statute that would otherwise
be applicable where to do so would contravene that statute or cause
any part of these terms to be void.
Booking Terms & Conditions
PLEASE READ ALL TERMS AND CONDITIONS CAREFULLY BEFORE MAKING ANY
BOOKING THROUGH THIS SITE.
Harvey World Travel (HWT) are licensed travel agents.
Words defined in Legal Notices and Disclaimers have the same meaning
in these terms.
Legal Contract
When you click to make a booking with us legal obligations arise
and your right to refund of monies charged to your credit card or
paid in any other way agreed by us, are limited by our terms and
policies and by the conditions of the particular supplier. Hyper
links will be provided and/or the website detail of such suppliers
will be displayed and it is your duty to go to such websites and
peruse each supplier’s terms and conditions as you will be
deemed to have done so, to have understood them and to have agreed
to be bound thereby. You must not make any booking through this
site unless you understand and agree all our terms and policies.
Once payment is made for the booking, it is deemed that you have
read and understood the terms and conditions for the booking. If
you have any queries please contact us before making any booking
for any service. When you request quotations or estimates or make
a booking or if any service are rendered to you, you are deemed
to have read and accepted all the Terms and to have the authority
to do so on behalf of the person in whose name the estimate or quotation
or reservation is requested or booking is made and/or provided and/or
the person to whom the services is rendered (collectively referred
to as ‘you’).
Agency
Products and services are sold by HWT as an agent for airline and
wholesale companies and other suppliers providing products and services,
including accommodation and transportation services. HWT is not
a provider of services and has no responsibility for services provided
or not provided by any party. We give and make no warranty or representation
regarding the standard of any service or product to be supplied
and no person has authority to make any such representation or warranty
on behalf of HWT. Accordingly HWT accepts no liability for any loss,
damage, injury, illness, harm or death which you may suffer as a
result of any act or omission on the part of or the failure of any
such third party to fulfill their obligations, whether in relation
to travel arrangements, accommodation or otherwise. All tickets,
coupons, exchange orders, vouchers and receipts are issued subject
to the appropriate tariffs and terms and conditions of sale of suppliers
and these terms. They are issued by us as agent only. It’s
your responsibility to familiarise> yourself with such terms
and conditions. We have no responsibility, and extend no guarantees
for discontinued promotions, airfares or specific holiday products.
Liability
Any bookings are made on the express condition that HWT, its employees
and agents, shall not be responsible for, and shall be exempt from,
all liability in respect of loss, damage, accident, injury, illness,
harm, trauma, death, delay or inconvenience to or additional expense
incurred by you (which shall be deemed to include your heirs, executors,
administrators or assigns), your luggage, or other property, howsoever
caused whether or not arising from any act, omission, default, or
negligence on the part of HWT whatsoever, unless such claim is due
to the gross negligence of HWT and such claim is lodged in writing
with HWT within 30 (thirty) days after the end of the booking. Such
liability will be subject to a limitation of R10 000, 00 (Ten Thousand
Rand) per traveler per booking.
HWT has and accepts no liability for any act, omission
or default, whether negligent or otherwise, of airlines, car rental
operators, ferry companies, hoteliers, tour operators or any other
supplier. We have no liability for any loss or damage occasioned
by the negligence, act or omission of any supplier or other third
party. We reserve the right to cancel or modify itineraries or bookings
where circumstances require.
In circumstances where liability of HWT cannot be excluded, such
liability is limited to the value of the purchased travel arrangements.
HWT reserves the right to decline any booking for any individual
on any tour or other service. Under no circumstances whatsoever
and howsoever arising will HWT be liable for any consequential,
indirect or special loss or damage whatsoever.
Illustrations
Photographs and illustrations and other promotional material are
for promotional purposes only. They do not represent any benefit
that will be included in any arrangements made by you.
Availability
The products and services sold through HWT are subject to availability
and can be withdrawn without notice. Access to this site and any
site normally linked to this site is not guaranteed and is subject
to availability of communications links and access rights. HWT reserves
the right to deny password login on this site to any person or password
holder.
Customer Profile
You have the option to complete a customer profile when joining
HWT. Please be aware that the profile applies to the password holder
but will also extend to any other persons on the same booking. If
other individuals travelling on your booking require different particulars,
you will need to contact us. Please note that the Customer Profile
does not guarantee that the matters selected in your profile will
be available to you. We will endeavour to accommodate your requests
but cannot guarantee availability. If you have any queries or if
any matter specified is important to you, please contact us.
Please also be aware that your profile current at the time of a
booking will be used for booking details. This means that you must
check that your profile is up to date before making a booking. If
amendments are needed at any time, you must make the amendments
before making a booking.
Passenger Name
It is essential that you enter details of each traveller correctly
and according to passport or other identification. Some suppliers
will deny carriage if the traveller ' s name varies from your booking
and may cancel automatically if the traveller ' s name is amended.
HWT has no responsibility for any loss or damage arising from incorrect
entry of traveller ' s name or any inability to travel as a result
of carrier ' s policies.
Unlicensed Entity Disclaimer
If you request HWT to arrange for the provision of products or services
by a person or company which is not licensed in accordance with
any applicable law, HWT accepts no liability (whether in contract,
for negligence or otherwise) for any loss or damage suffered by
you or any third party as a result.
Special Conditions for Products
The terms displayed on this website apply generally to all the products
and packages sold by HWT. Some products also have special conditions
applying to them. Airlines, hotels, wholesalers and other suppliers
have various other terms and conditions relating to the purchase
of these goods and services. Some of those terms will be displayed
in the Rules applicable to a particular product, but not all. For
example, suppliers often limit or exclude liability in respect of
death, personal injury, delay and loss or damage to baggage, however
we do not have those conditions to display. It is your responsibility
to check those terms and conditions before making a booking through
HWT.
Air Fare - Special Conditions
There are numerous rules and regulations affecting most advance
purchase and other discounted air fares, which involve substantial
cancellation or amendment fees, and in some instances there are
no refunds whatsoever on cancelled holidays and or air tickets should
you need to amend or cancel your travel plans. If you have any queries
regarding these fees please do not hesitate to contact our office.
You must read the Rules and check the conditions applicable to every
airfare and ensure that you accept those Rules and conditions before
you make a booking. If the Rules and conditions are not displayed
you should contact our office. Once you confirm a booking and make
payment you are bound by the Rules and conditions applicable to
the relevant supplier.
Alterations to Tour Itineraries by Suppliers
In the event of material alterations by a supplier to a proposed
tour booked by you, you may be given the option of cancelling the
tour without penalty but this is not guaranteed. The right to cancel
is subject to the conditions of the supplier. Your acceptance of
any tickets, coupons, exchange orders, vouchers and receipts will
be deemed acceptance of the above conditions and of any alterations
made to your tour.
Frequent Flyer Customers
Please note if you are a frequent flyer member you should retain
your air ticket and boarding pass as HWT cannot be held responsible
for obtaining copies of your air ticket at any future date.
Flight Timings, Departure Points, Flight
Numbers
The timings shown on your ticket are subject to reconfirmation on
both OUTBOUND and INBOUND journeys. Please contact the applicable
Airline at least 72 hours before departure (This includes connecting
flights, both internationally and locally). HWT does not accept
responsibility for amended flight timings or numbers.
Travel Documents
It is very important that you read the following information carefully
and contact us if you require any assistance in any area.
Photo ID
All airlines require the production of Photo ID when checking in
with an e-ticket. Your ID must match with the name of the passenger
on the ticket. Each traveler must have their Photo ID including
children. You may also have to produce the credit card you used
to process the payment. Please note that bookings made and paid
for by a third party may require the traveler to produce a copy
of the front and back of such credit card and if payment was made
in cash or by EFT, proof of payment as well as a letter from the
party making the booking authorizing the traveler to travel –
check with the airline concerned.
Passport
All individuals departing from South Africa must be in possession
of a valid passport. If your passport is due to expire within six
months of your return arrival back in South Africa then under normal
circumstances you should obtain a new passport. Should you be travelling
on anything other than a South African Passport then it is your
responsibility to bring this to our attention as you may require
a visa or permit to re-enter South Africa .
Visa Requirements
Certain countries require a Visa for entry prior to arrival. Please
ensure you are fully informed of the requirements before you make
a reservation as visas can take some time to obtain. Vaccinations
are strongly recommended for certain destinations. Please contact
your local doctor who will advise you of these requirements. Please
note that vaccinations may be recommended some period in advance
of travelling.
PLEASE NOTE: Passport, visa and
health compliance and requirements are EXCLUSIVELY the responsibility
of the passenger and Harvey World Travel accepts absolutely no responsibility
in this regard.
Health
It is the entirely your duty to ensure that any vaccinations, inoculations,
prophylactic (e.g. for malaria) and the like, where required, have
been obtained. Please check the requirements with HWT before travelling.
HWT will endeavour to assist you but such assistance will be at
HWT ' s discretion and you acknowledges that in doing so, the HWT
is not assuming any obligation or liability and you indemnify HWT
against any consequences of non-compliance. It is your duty to familiarise
him/herself with the inherent dangers of and mental and/or physical
condition required for the booking. Please note that All visitors
to South Africa are required to have a minimum of three blank pages
in their passport excluding the front and back cover to enable the
entry visa to be issued. If there is insufficient space in the passport
entry will be denied and the person is likely to be detained pending
return to their country of origin. Please ensure that all passports
are renewed. Malaria and other tropical diseases: WARNING Certain
parts covered by your itinerary are areas where there is a high-risk
of malaria and other tropical diseases. We strongly recommend that
the necessary precautions be taken in this regard and recommend
that you check with your medical practitioner before departure or
a medical practitioner well versed in tropical diseases immediately
upon your arrival in Africa or any other tropical or sub-tropical
destination. If you have not done so prior to departure, it is imperative
you do so upon your return.
Travel Insurance
We strongly recommend that all clients take out comprehensive insurance
when making a booking. We recommend that insurance covers at least
loss of deposit and other monies through cancellation, loss or damage
to personal baggage and loss of money, medical expenses, additional
expenses to cover hotel accommodation and repatriation costs to
South Africa should any services need to be extended or curtailed
due to illness, repatriation of remains or other insurable risk
(Please note that this is a recommendation only and NOT an exclusive
list). Please note that restrictions on the time to effect insurance
apply to some services such as airfares. Please contact us to arrange
travel insurance before making payment for a service.
HWT will not be responsible or liable if you fails
to take adequate insurance cover or at all. It shall not be obligatory
upon HWT to effect insurance for you except upon detailed instructions
given in writing and all insurance effected by HWT pursuant to such
instruction will be subject to such exceptions and conditions as
may be imposed by the insurance company or underwriters accepting
the risk, and HWT shall not be obliged to obtain separate cover
for any risks so excluded. Should the insurers dispute their liability
for any reason, you will have recourse against the insurers only.
Once the insurance has been confirmed and paid for,you will be issued
with a policy document of the insurer. It is a complex document,
which must be read BEFORE YOU initiate your travel so that you can
address any queries you may have to the insurer PRIOR to your departure.
Please note that various credit card companies
offer limited levels of travel insurance, which is not considered
sufficient cover for international travel. Kindly check with the
respective credit card companies in order to obtain the specific
details of the cover.
Rates and Price Variations
We reserve the right to vary published rates in the event of changes
in exchange rates or price rises made by wholesalers or other suppliers.
If the cost of any service increases due to exchange rate fluctuations,
price increases, tax changes or any other reason, you must pay the
increase when notified. We are not liable in any way if any increase
occurs. Rates quoted are per tour, per night accommodation, per
crossing ferries, per package; as appropriate to the particular
product. Car rental is based on a 24 hour period commencing from
the time of pick-up throughout unless otherwise specified. All prices
are subject to availability and can be withdrawn or varied without
notice.
Currency
All prices quoted in the flight booking engine are in South African
Rand, regardless of where your requested flight is departing from.
Ticketing
For International departures most airlines issue e tickets, which
will be emailed to the email address provided when making an online
booking. Some airlines require paper tickets. These will need to
be posted to you at the address provided. If you are departing within
4 weeks you may be required to pay an additional fee to have these
tickets posted, delivered by courier or made available at the airport.
Alternatively, you can choose to collect your ticket(s) locally.
If your tickets are paper tickets and you live outside of South
Africa then postage or courier charges or airline ticketing fees
will apply. For South African Domestic itineraries, passengers will
be provided with an e-ticket receipt upon payment and completion
of the booking process.
Price Inclusions and Exclusions
Items included in the prices or rates of the products or services
are specified in each section. Prices do not include, meals other
than as stated in itineraries, any air fares unless stated, Government
departure taxes, passport and visa charges, vaccination fees, airport
taxes, any items of a personal nature such as telephone calls, beverages,
laundry, excess baggage charges and gratuities, travel insurance
or other items not specified.
Goods and Services Tax
Prices quoted do not include goods and services tax or similar tax
("VAT"). VAT is payable by you in respect of any supply
made to you, and in addition to the price payable. You must pay
the amount of VAT payable in the respect of the supply. VAT is payable
at the same time and in the same manner as the price or at such
later time as HWT may request. lf you have any questions regarding

Service Fees
Harvey World Travel professional service fees may apply. A Menu
of Services is available from your Harvey World Travel consultant
upon request. A surcharge may apply for credit card transactions.
Credit card payments are subject to due completion of and upon the
terms and conditions specified in HWT’s credit card authorization
form.

Travel Gift Cards – Terms and Conditions
of Use
Harvey World Travel Gift Cards are redeemable for merchandise or
services at participating Harvey World Travel shops in South Africa
only (excluding travellers cheques and bookings made online). The
gift card is not redeemable for cash. The card must be redeemed
before the expiry date shown on the wallet and card and will be
void and may not be redeemed after the expiry date. In any event,
gift cards expire 12 months from the date of issue. The card cannot
be reloaded or increased after issue and is partially redeemable
in that it can be used on more than one occasion. If purchase exceeds
available card balance, the cardholder must make up the difference
by making an additional payment. Cash will not be given for any
unused balance and any unused balance on expiry of the card will
not be refunded or credited. We reserve the right to change any
terms contained in these Terms and Conditions of Use at any time.
Changes to Terms and Conditions of Use will be available on our
website or at participating shops. Mutilated, lost or stolen cards
may, at the sole discretion of HWT, be replaced or redeemed upon
the payment of a replacement fee (as determined by HWT). The cardholder
is liable for all transactions on the card and can check the available
card balance by calling the Gift Voucher help desk on 021 410 3685.
The cardholder can also contact the Gift Voucher help desk if they
have any reason to believe that there has been an unauthorised or
mistaken transaction or the card is lost or stolen. Please note
that professional service fees may apply when making a booking through
HWT.
Law & Jurisdiction
South African law and the jurisdiction of South African courts will
govern the relationship between you and HWT HWT will be entitled
to institute any legal proceedings arising out of or in connection
with this contract in any Magistrates Court having jurisdiction
in terms of Section 28 of the Magistrates Court Act no. 32/1944
as amended, notwithstanding that the amount in issue may exceed
the limits of such jurisdiction.
Conduct
You agree that you will at all times comply with HWT or the supplier’s
or others’ requirements in regard to your conduct and you
will not in any way constitute a nuisance to any other passenger
on the tour.
Special Requests
Special requests must specified in writing to HWT. Whilst HWT will
use its best endeavours to accommodate such requests, it does not
guarantee that it will.
